Miles Davis after being beaten by New York city police August 25, 1959 and released on bond. |
Why We Raise the Fist. Why we sit. Why we kneel. Did you know Miles Davis was the victim of police brutality? Every week the same refrain 'they brought it on themselves'. 'If only they would have complied' - dot dot dot. That uppity negro.
On August 25, 1959 in New York City, Miles Davis was beaten and arrested by the police, for SWB (standing while black) in front of the nightclub Birdland.
...A white police officer, Gerald Gilduff, ordered Miles to “move on.” Davis replied, “Move on, for what?" While engaged with the initial officer another policeman comes up and hits Miles in the head with a billy club. Miles would write later in his autobiography "Blood was running down the khaki suit I had on." Witnesses said Detective Donald Rolker hit Davis many times. Approximately a dozen witnesses stated Detective Rolker was drunk at the time of the incident.
Miles eventually posted $1,000 bail for his release pending trial. He was charged with third degree assault and disorderly conduct. You know what Malcolm X said, ~ " They put their club upside your head. And then turn around and accuse you of attacking them... They attack you, bust you all upside your mouth, and then take you to court and charge you with assault... "
Eventually, Miles was exonerated. From the trial a piercing succinct commentary, "It would be a travesty on justice to adjudge the victim of an illegal arrest guilty of the crime of assaulting the one who made the arrest." Justices Grassman, Dunaif and Richman cleared then 33 year old Davis after an all day trial." - Michael Scipio
